By using the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services. Dearly Song is referred to as "we," "us," or "our."
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering, you confirm that the information you provide is accurate and that you are authorized to use the payment method used.
Our products
Dearly Song creates custom, made-to-order songs based on the details you submit, delivered digitally. Songs are generated with the help of music production tools and creative processes. Delivery timeframes depend on the option selected at checkout, as described in our Delivery Policy.
Content you provide
When you submit names, stories, messages, and other details for your song ("Your Content"), you represent that you have the right to share it and that it does not infringe anyone's rights or violate any law. You grant us a license to use Your Content for the purpose of creating, producing, delivering, and supporting your song, and to keep records as needed. You agree not to submit content that is unlawful, hateful, harassing, defamatory, sexually explicit involving minors, or that infringes intellectual property or privacy rights. We may decline or cancel any order that violates these Terms.
Ownership and use of your song
Upon full payment, you receive your custom song for personal, non-commercial use, such as gifting it, playing it, and sharing it with friends and family. Unless we agree otherwise in writing, we and our licensors retain ownership of the underlying compositions, recordings, and production. Commercial use (such as resale, broadcast, or use in paid advertising) requires our prior written permission.
Orders, pricing, and payment
Prices are shown at checkout and are listed in US dollars unless stated otherwise. We may correct pricing errors and cancel affected orders. Payment is processed securely at the time of purchase.
Revisions and refunds
Every order is backed by our 100% Satisfaction Guarantee, with unlimited free revisions until you are happy. Because our products are custom-made and digital, all sales are final and monetary refunds are not provided once production has begun, as described in our Refund Policy.

Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
Indemnification
You agree to indemnify and hold Dearly Song harmless from any claims or damages arising out of Your Content or your breach of these Terms.
Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the courts located in Wyoming, unless applicable law provides otherwise.
Changes to these Terms
We may update these Terms from time to time. The revised version will be posted here with an updated "Last updated" date, and your continued use of the Services constitutes acceptance.
